Terms of Use for Dishkin AI: Recipes Generator

These Terms of Use ("Terms") govern your access to and use of Dishkin AI: Recipes Generator ("Dishkin", "Dishkin AI", the "App"), including any related websites, services, AI features, subscriptions, and content provided by Evgenii Evsiukov ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App. If you use the App on behalf of another person, you confirm that you have authority to accept these Terms on their behalf.

1. About the App

Dishkin AI is an AI-powered recipe generator, pantry assistant, cooking diary, recipe book, shopping list, and cooking utility application. The App may help users recognize ingredients from photos, scan grocery receipts, generate recipes from available ingredients, refine recipes, save recipes, track pantry items, manage shopping lists, schedule local reminders, and keep a cooking diary.

The App is designed for personal cooking assistance and general informational purposes. It is not a professional culinary service, nutrition service, medical service, allergy safety system, food safety authority, or emergency service.

2. Eligibility

You may use the App only if you are legally permitted to do so in your country or region and are able to enter into a legally binding agreement. If you are under the age of legal majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian.

The App is not directed to children under 13, or under the minimum age required by applicable law in your country or region. Parents and guardians are responsible for supervising children's use of cooking, kitchen, AI, and food related tools.

3. Your Account, Device, and Local Data

The App may allow you to use many features without creating a traditional account. Some functionality may rely on your device, local storage, app store account, purchase receipt, subscription entitlement, or other technical identifiers.

You are responsible for maintaining the security of your device, app store account, backups, exported files, and any information you store in the App. We are not responsible for loss of data caused by device damage, deletion of the App, operating system errors, third-party backup settings, user error, unauthorized access to your device, or failure to export or back up your data.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect information related to the App, including pantry data, recipes, diary entries, photos, AI requests, analytics, subscriptions, support communications, and device information.

By using the App, you acknowledge that you have read and understood the Privacy Policy.

5. AI Features

The App may include AI-powered features, including recipe generation, ingredient recognition from photos, receipt parsing, recipe refinement, recipe classification, nutrition estimates, and other AI-generated suggestions.

AI-generated content may be inaccurate, incomplete, unsafe, outdated, inappropriate, or unsuitable for your personal circumstances. You are responsible for reviewing, verifying, and deciding whether to use any AI-generated recipe, instruction, estimate, ingredient suggestion, cooking time, storage advice, or other output.

You must not rely on AI-generated content as a guarantee of ingredient safety, allergen safety, nutrition accuracy, food safety, cooking success, or suitability for any particular diet, health condition, pregnancy, child feeding, allergy, or medical need.

6. Food Safety and Allergy Disclaimer

Recipes, ingredient suggestions, expiration reminders, nutrition estimates, cooking times, storage suggestions, and related content are provided for general informational and convenience purposes only.

You are solely responsible for checking ingredients, reading product labels, verifying allergens, confirming expiration dates, following safe food handling practices, cooking food to safe temperatures, avoiding cross-contamination, and deciding whether a recipe is appropriate for you or anyone you cook for.

If you have allergies, intolerances, medical conditions, pregnancy-related dietary restrictions, religious dietary requirements, or other specific food requirements, you should consult qualified professionals and carefully verify all ingredients before preparing or consuming any recipe.

The App may allow you to enter allergies, disliked foods, favorite foods, appliances, cuisine preferences, skill level, servings, and other preferences. These features are intended to improve personalization, but they do not guarantee that AI outputs will exclude every unsafe, unwanted, or unsuitable ingredient.

7. Nutrition Disclaimer

Any nutrition values shown in the App, including calories, protein, carbohydrates, fat, portions, serving sizes, or other estimates, are approximate and may be generated by AI or calculated from incomplete information.

The App is not a dietitian, nutritionist, doctor, medical device, or health service. Nutrition information in the App should not be treated as medical, dietetic, or professional advice. Consult a qualified healthcare professional before making decisions related to medical treatment, diet, weight management, allergies, pregnancy, chronic disease, or any health condition.

8. User Content

"User Content" means any information, text, photos, images, ingredients, recipes, pantry items, diary entries, notes, ratings, shopping lists, preferences, support messages, or other content that you enter, upload, submit, save, import, export, share, or generate through the App.

You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, transmit, display, and use your User Content only as necessary to provide, maintain, secure, support, and improve the App, including AI functionality, subscription validation, diagnostics, support, and related services described in these Terms and the Privacy Policy.

You are responsible for ensuring that your User Content is accurate, lawful, and does not violate the rights of any third party. You must not submit content that is illegal, abusive, threatening, defamatory, discriminatory, hateful, sexually explicit, exploitative, misleading, fraudulent, harmful, infringing, or otherwise inappropriate.

9. Photos, Receipts, and Voice Input

The App may allow you to take or select photos of ingredients, pantry items, shopping list items, cooked dishes, or grocery receipts. When you use recognition features, selected images may be processed by our backend and AI service providers to identify ingredients, products, or recipe-related information.

The App may allow voice input for ingredients or other cooking-related text. You are responsible for reviewing recognized text before using it to generate recipes or other content.

You must not upload photos, receipts, audio, or other content that you do not have the right to use, or that contains sensitive personal information you do not want processed by the App or relevant service providers.

10. Acceptable Use

You agree to use the App only for lawful personal purposes and in accordance with these Terms.

You must not:

  • use the App for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose;
  • interfere with the operation, security, availability, or integrity of the App or related services;
  • attempt to reverse engineer, decompile, disassemble, modify, or extract source code from the App except where permitted by law;
  • attempt to bypass, disable, or abuse technical limits, subscription limits, AI request limits, rate limits, or security controls;
  • use bots, scripts, automation, scraping, or other automated tools to abuse the App or extract data unlawfully;
  • submit malware, malicious prompts, harmful content, or content designed to exploit AI or backend systems;
  • use the App to infringe intellectual property, privacy, publicity, or other rights of any person;
  • use the App to generate or distribute dangerous, illegal, deceptive, or harmful instructions or content;
  • misrepresent your identity or impersonate another person;
  • use the App in a way that may overload, damage, disable, or impair our systems, AI providers, app stores, or other third-party services.

11. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the App for your own personal, non-commercial purposes.

This license does not transfer ownership of the App to you. You may not copy, modify, distribute, sell, rent, lease, sublicense, publish, create derivative works from, or otherwise exploit the App or any part of it except as expressly permitted by these Terms or applicable law.

12. Intellectual Property

The App, including its design, interface, graphics, text, software, code, algorithms, features, logos, icons, names, trademarks, content, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

Except for your limited right to use the App under these Terms, no rights are granted to you in or to the App. You may not remove, obscure, or alter any copyright, trademark, or proprietary notices in the App.

13. Free Features

The App may offer free features that can be used without payment. Free features may be subject to limits, including limits on AI generations, photo recognition, receipt scanning, recipe refinement, or other functionality.

We may change, limit, add, remove, suspend, or discontinue free features at any time, subject to applicable law.

14. Paid Features and Premium Subscription

The App may offer paid features, premium access, subscriptions, free trials, introductory offers, promotional prices, or other paid services ("Paid Services"). Paid Services may include higher AI usage limits, premium AI features, advanced recipe generation, additional personalization, or other features shown in the App or app store at the time of purchase.

The exact price, billing period, trial availability, renewal terms, included features, and cancellation instructions will be displayed before purchase in the App, Apple App Store, Google Play, or another authorized payment provider.

We may modify, add, replace, or remove Paid Service features over time for reasons such as product improvement, security, legal compliance, technical limitations, third-party service changes, AI provider changes, app store requirements, or business reasons. Where required by law or platform rules, we will provide notice of material changes affecting active paid users.

15. Payment, Auto-Renewal, and Cancellation

Payments are processed by Apple App Store, Google Play, or another authorized payment provider. By purchasing a subscription or other Paid Service, you authorize the applicable payment provider to charge your selected payment method according to the plan and terms shown at purchase.

Subscriptions are generally auto-renewing unless cancelled before the end of the current billing period. Your account may be charged before the beginning of the next billing period according to the rules of the app store or payment provider.

To avoid renewal, you must cancel your subscription before the renewal date using the subscription management tools provided by Apple App Store, Google Play, or the relevant payment provider. Deleting the App, uninstalling the App, or stopping use of the App does not cancel your subscription.

16. Free Trials and Promotional Offers

The App may offer free trials, introductory prices, discounts, promotional subscriptions, or limited-time offers. Eligibility may depend on your app store account, country, previous subscriptions, device, platform, or other criteria.

If you start a free trial and do not cancel before the trial ends, the trial may automatically convert into a paid subscription. We do not control eligibility decisions, billing timing, trial management, or promotional offer rules applied by Apple, Google, or other payment providers.

17. Refunds

All payments, refunds, chargebacks, billing disputes, and cancellation requests are handled according to the rules of the platform or payment provider through which you purchased the Paid Service.

If you purchased through Apple App Store, refund requests must be submitted to Apple and are subject to Apple's refund policies. If you purchased through Google Play, refund requests must be submitted to Google and are subject to Google Play's refund policies. We do not control Apple's or Google's refund decisions and cannot guarantee that a refund will be granted.

Where required by applicable consumer law, you may have additional rights that cannot be excluded by these Terms.

18. Restore Purchases

The App may provide a restore purchases feature. Restore purchases allows you to restore active subscriptions or previous eligible purchases using the app store account used for the original purchase.

Restoration may not work if you are signed into a different app store account, if the subscription has expired, if the purchase was refunded, if the app store service is unavailable, or if there is a technical issue outside our control.

19. App Availability and Updates

We may update, modify, suspend, interrupt, or discontinue the App or any feature at any time. The App may be unavailable due to maintenance, updates, network issues, device limitations, operating system changes, app store issues, third-party service outages, AI service outages, security incidents, or events outside our control.

We do not guarantee that the App will be available uninterrupted, error-free, secure, or compatible with every device, operating system, country, language, or app store account. Some updates may be required for continued use of the App, compatibility, security, or access to certain features.

20. Third-Party Services

The App may use third-party services to provide certain functionality, including AI processing, analytics, subscription management, payment processing, app store distribution, speech recognition, text-to-speech, camera, photo library, file sharing, notifications, and device storage.

Third-party services may include Google Gemini API, Firebase Analytics, Google Analytics for Firebase, RevenueCat, Apple App Store, Google Play, and device platform services provided by Apple, Google, or your device manufacturer.

Your use of third-party services may be subject to their own terms, privacy policies, platform rules, and service availability. We are not responsible for third-party services, outages, decisions, data practices, pricing, refund rules, policy changes, or content.

21. Export, Import, Sharing, and Backups

The App may allow you to export, import, or share recipes, pantry data, diary entries, shopping lists, backup files, or other content. You are responsible for deciding what to export or share and for protecting exported files.

If you share content through your device's share sheet or another app, the selected third-party app or service will process that content according to its own terms and privacy policy. We are not responsible for how third parties handle content you choose to share with them.

22. Feedback

If you send us feedback, suggestions, ideas, bug reports, feature requests, or other comments about the App, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, publish, distribute, and incorporate that feedback into the App or other products without compensation to you.

23. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, uninterrupted operation, compatibility, or non-infringement.

We do not warrant that AI outputs, recipes, nutrition estimates, ingredient recognition, receipt parsing, pantry data, expiration reminders, shopping lists, cooking timers, or other App content will be accurate, complete, safe, reliable, available, or suitable for your needs.

24. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, business interruption, device damage, personal injury, illness, allergic reaction, food spoilage, cooking failure, purchase decision, subscription issue, or other damages arising out of or related to your use of or inability to use the App.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights.

25. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the App, your User Content, your violation of these Terms, your violation of applicable law, or your violation of any third-party rights.

26. Termination

You may stop using the App at any time by uninstalling it and cancelling any active subscription through your app store account settings. We may suspend, restrict, or terminate your access to the App or any feature if you violate these Terms, abuse the service, create security or legal risk, misuse AI features, fail to pay for Paid Services, or if required by law or platform rules.

Termination does not automatically cancel an app store subscription. You must cancel subscriptions through the platform where you purchased them.

27. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you in the App, on our website, or by other appropriate means. The "Last Updated" date at the top of these Terms shows when they were last changed.

Your continued use of the App after updated Terms become effective means you accept the updated Terms, where permitted by law. If you do not agree to updated Terms, you must stop using the App and cancel any active subscription if you do not want it to renew.

28. Governing Law

If you reside in the European Union, these Terms shall be governed by the laws of your country of habitual residence to the extent required by applicable consumer protection law. In all other cases, these Terms shall be governed by and interpreted in accordance with the laws of Spain, without regard to conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights or protections that you may have under the laws of your country or region.

29. Apple Standard EULA

Where applicable, your use of the App is also subject to Apple's standard Licensed Application End User License Agreement. If there is a conflict between these Terms and Apple's standard EULA for iOS App Store distribution, Apple's required terms may apply to the extent required by Apple's platform rules.
